Automated Messages for Marketing and Notifications:
- You will only receive automated SMS or emails for marketing or notifications after you explicitly opt in by providing a strict “YES”.
- You can opt out at any time by replying “STOP” or using the unsubscribe link in emails.
3. Compliance With Industry Standards
10DLC Messaging (U.S. & Canada):
- All text messages are sent in compliance with 10DLC regulations.
- CalVerity is a registered 10DLC sender; we use verified campaigns for message transparency.
STIR/SHAKEN Caller Authentication:
- We implement STIR/SHAKEN protocols to ensure all calls from CalVerity are properly authenticated and protected from spoofing.

10. User Responsibilities
Users are responsible for maintaining the confidentiality of their credentials and any activity conducted under their account. CalVerity is not responsible for unauthorized access resulting from user negligence.
11. Indemnification
You agree to indemnify and hold harmless CalVerity and its affiliates from any claims, damages, or liabilities arising from your use of our services or violation of these terms.
12. Force Majeure
CalVerity shall not be liable for delays or failures in performance resulting from events beyond our reasonable control, including natural disasters, power outages, labor disputes, or government restrictions.
13. Future Services and Feature Rollouts
CalVerity may introduce new features, including but not limited to:
- AI-powered diagnostics and threat detection
- Customer self-service dashboards and billing portals
- Cloud-native infrastructure services
- Subscription software products
Use of any future services will be governed by updated service agreements and/or addendums to these Terms. Continued use of CalVerity services after the deployment of such features will constitute agreement to any updated terms and privacy practices.
14. Specific Services and Usage Scenarios
The following outlines more detailed and specific types of services CalVerity may provide now or in the future, along with the terms governing their use:
- **Virtual Private Servers (VPS) and Dedicated Hosting**: Clients renting server infrastructure from CalVerity are responsible for securing the content and services hosted therein. CalVerity reserves the right to suspend services if illegal or abusive activity is detected.
- **VoIP, PBX, and SIP Trunking**: Use of our telephony services must comply with U.S. FCC regulations, including 911 compliance and lawful call origination. Spoofing caller ID, transmitting spam or robocalls, or violating 10DLC requirements is strictly prohibited.
- **Security-as-a-Service (SECaaS)**: CalVerity may offer endpoint protection, firewall management, and intrusion detection services. Users agree to keep their systems updated and to cooperate with forensic investigations if a breach is suspected.
- **Cloud Migration and Management**: For clients using public cloud providers under our management (e.g., AWS, Azure, Google Cloud), CalVerity acts as a service integrator and administrator. The client retains ownership of their data.
- **Custom Scripting, Automation, or Software Development**: Any custom scripts or automation tools developed by CalVerity are licensed for the client’s internal use unless otherwise specified in writing.
- **Disaster Recovery Plans and Simulations**: We may simulate outages or failover procedures to validate disaster recovery readiness. Participation in these simulations is optional but strongly recommended.
- **API Integrations and Third-Party Services**: When connecting systems via API (e.g., CRM, ticketing, payment gateways), clients must provide accurate credentials and accept the third-party terms of use.
- **Client Training and Documentation**: CalVerity may provide client-specific documentation, user guides, or training videos. Redistribution of these materials outside the client’s organization is not permitted.
- **Professional Services and Consulting**: For strategic planning, audits, compliance assessments, and project management, CalVerity operates under deliverables and timelines agreed upon in writing. Delays caused by the client may affect project timelines.
These expanded terms aim to clearly define roles, responsibilities, and expectations for complex technical services that go beyond day-to-day support. Any new services launched by CalVerity will include specific service-level agreements (SLAs) or addenda as needed.
15. Severability and Enforcement
If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason, the remaining provisions shall remain in full force and effect and shall be construed so as to best effectuate the original intent of the parties.
CalVerity reserves the right to pursue any and all legal remedies available under applicable law for violations of these Terms, including injunctive relief, damages, and termination of access to services. Failure to enforce any provision shall not constitute a waiver of such rights.
These Terms of Use shall be construed in accordance with the laws of the State of California, without regard to conflict of law principles, and shall constitute the entire agreement between the user and CalVerity regarding use of the company's services unless otherwise specified in a separate, signed service agreement.
16. Subdomains, Regional Disclosures, and External Systems
To accommodate the expansion of services and jurisdictional operations outside of the United States, CalVerity Network Systems, LLC may operate regional websites, subdomains, or service-specific web addresses (e.g., portal.calverity.com, eu.calverity.com, support.calverity.com). Such subdomains are operated directly or under delegated administration by CalVerity staff or verified affiliates and are considered official digital properties of the company. Terms applicable to the primary domain (www.calverity.com) apply equally to any subdomain or regional deployment, unless otherwise stated in a specific policy or agreement published therein.
Furthermore, for operational purposes including billing, customer support, remote diagnostics, and service configuration, CalVerity may employ the use of third-party software or platforms. These may include, but are not limited to:
- Ticketing platforms and CRM systems
- Remote support tools
- Billing and payment processing gateways
- Cloud storage providers for document or backup hosting
Accessing these services implies agreement to the applicable third-party terms of use and privacy policies. CalVerity retains oversight responsibility for third-party vendors with respect to data protection, contractual compliance, and the integrity of services provided.
Clients who previously opted into receiving automated messaging (including email and SMS) may withdraw their consent at any time. Emails include an 'unsubscribe' option for one-click removal. Text message recipients may send the word “STOP” to immediately trigger removal from future messaging. CalVerity’s systems will reflect the change within twenty-four (24) hours. In the unlikely event of a system failure to process the opt-out, clients must notify us at legal-automated-messaging@calverity.com, where a manual override will be executed without undue delay. .
